Lawsuits for Slip & Fall Accidents
The details of your slip and fall accident are unique, but there is one critical fact common to all claims: Time is of the essence. The sooner you retain a personal injury lawyer, the greater your chances of success.
Under the Alberta Limitations Act, you generally have two years to file a claim, and this is a complicated area of law. If you fail to start an action in time, it will usually prevent you from making a claim and receiving compensation.
To avoid this, contact an experienced personal injury lawyer at Foisy Law as soon as possible after your injury.

Regardless of where and how you’re injured, the damage from a slip and fall accident can have lifelong implications for your health and way of life.

Foisy consistently goes above and beyond normal expectations. Down to earth, kind, friendly, fair, professional- are only a few of the many qualities he exudes.
What You Need to Know
Whether you are the person injured or not, you’ll benefit from having quality answers to the most common personal injury lawyer questions. Understanding these will help guide you in choosing an attorney that will have your best interests at heart.
Do I really need a Personal Injury Lawyer?
No. But it is unrealistic to think that you will be able to get the same results without one.
What should I do if I'm in an accident?
- Seek medical attention. Be sure to get a proper diagnosis of your injuries and receive medical treatment promptly, even if you feel fine.
- Report your accident. Make sure there is a record of the incident that includes what happened and when, names of witnesses and their contact, and any other relevant details. If possible, obtain photographic evidence.
- Provide notice of your accident to your insurance company promptly. as there may be time limits involved.
- As soon as possible, contact us to discuss your case.
What determines how much I can receive?
The value of your claim depends on a range of factors, including the severity and cause of the injury, the medical evidence (most important), treatment history, and how it has affected your life.
What can a Personal Injury Lawyer do for me?
Apart from easing your stress and guiding you through the complex claim process, people who work with an experienced personal injury lawyer receive considerably higher compensation than what they would get by themselves.
Can I receive benefits from my insurance company?
In Alberta, Section B Benefits are insurance benefits for people who are injured in automobile accidents, or who have loved ones who were injured or killed in automobile accidents. By law, every Alberta automobile insurance policy must contain a Section B clause.
Section B benefits are known as “no-fault” benefits, meaning that your right to claim them does not depend on whether or not you were at fault for the automobile accident that caused your injuries. These benefits cover certain expenses related to medical treatments, disability, and death.
Note that Section B medical payments are limited to $400/week.
What happens if the other driver doesn't have insurance?
If you’ve been injured in a vehicle accident and the at-fault driver doesn’t have valid insurance or flees the scene, you may not have anyone to sue for your injuries.
The Motor Vehicle Accident Claims Program (MVAC) provides you with a way to sue and get payment for your injuries. As a victim, you may qualify for up to $200,000 – if there’s more than one victim, the payment will be split based on a pro-rated rate among all of you.
How long will it take to resolve my case?
The litigation process can be a long one. Many personal injury cases take 2-3 years to resolve, however, it can take longer depending on your case.
If your case goes to court, it may take longer. In general, the more serious your injuries, the longer it can take to reach a fair resolution.
What can I sue for?
Every case is unique, but there are five key areas that determine what you can sue for and for how much.
- Pain & suffering
- Loss of earning capacity
- Loss of housekeeping capacity
- Future care costs
- Out of pocket expenses during your recovery (special damages)
Most claimants get pain & suffering, only some are entitled to the other 4. Thats why its important to contact Foisy Law to discuss your individual case and its unique merits.
